Se ordenó al Tribunal Superior del distrito Judicial de esta ciudad, poner en conocimiento la nulidad de todo lo actuado por ese despacho judicial a partir de la presentación de la demanda de tutela de la referencia, consideró la Corte que en este caso se vulneró el derecho de defensa.
Y en consecuencia, el citado Tribunal debe informar al demandante sobre la nulidad del proceso por no habérsele notificado desde el inicio.
Además, se le advertirá que si guarda silencio, la nulidad se entenderá saneada.

- PRIMERO. Se ORDENA al Tribunal Superior del distrito Judicial de esta ciudad, poner en conocimiento la nulidad de todo lo actuado por ese despacho judicial, a partir de la presentacion de la demanda de tutela de la referencia. En consecuencia, el citado Tribunal debe notificar al Conjunto Residencial "Montana" o su representante legal, si fuera el caso, de la nulidad que contiene el presente proceso, por no habersele notificado su iniciacion. Ademas, se le advertira que si guarda silencio, la nulidad se entendera saneada.
- SEGUNDO. Por Secretaria General, DEVOLVER el presente expediente al mencionado Tribunal para el cumplimiento de lo ordenado en el anterior numeral.
